By accessing or using our website, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, please do not use the site.

  1. About Us

The Precious Thoughts Group Ltd, hereafter referred to as Precious Thoughts is a digital platform providing secure content hosting, video recording/upload features, that allows users to create, manage, and share personalised tribute and memory pages to speak in your own voice about your unique life at your funeral or End of life event.

  1. User Account.

To create an account. You agree to provide accurate, current, and complete information and keep your login credentials confidential. A step-by-step guide is provided on this web site.

You can manage your account from your account dashboard.

  1. Payment Arrangements

Payment is due at the point of creating an account.

  1. Indemnity and Liability

You will indemnify us in full and hold us, our employees and agents harmless from and against all expenses, liabilities, losses, damages, claims and other reasonable expenses we may incur (directly or indirectly including financing costs and including legal costs on a full indemnity basis) in connection with or arising out of your use and any third party’s use of the services and following any breach by you of any of your obligations under these Terms. We may claim any losses from you at any time providing written notice.

We shall not be liable to you or any third party for any loss or damage (including any loss of profit, revenue, business, goodwill or anticipated savings (whether direct or indirect) and any indirect, consequential or special damages, loss, costs, claims or expenses), howsoever arising.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused as a result of our negligence, breach of contract or otherwise.

  1. Content Submission and Ownership

You retain ownership of the content you upload (e.g., videos, text, images). By submitting content, you grant Precious Thoughts a non-exclusive, royalty-free license to host, display, and share your content securely as intended by the platform. You are responsible for ensuring that any content you upload:

– Does not infringe any copyright, trademark, or privacy rights
– Does not contain offensive, harmful, or illegal material
– Has the appropriate consent of any individuals featured in the content
– Meets the various religious requirements of your faith

We reserve the right to remove or restrict access to any content that violates these Terms.

Upon account termination or after the passing of the Client and expiry of the retention period, your content will be deleted in accordance with our Privacy Policy, unless required for legal or audit purposes.

  1. Data Protection

Data Protection Act 2018 (the“Act”).

We respect the confidential nature of the information given to us and, where you provide us with personal data (“data”), we will ensure that the data will be held securely, in confidence and processed only for the purpose of carrying out the services.  When no longer in use your Data will be deleted in compliance of the Act.

Under data protection law you have the right to know what data we hold about you and, by applying to us in writing, receive a copy of that data. We will not charge a fee unless a request is manifestly unfounded or excessive.

You confirm that you have permission to also give consent to use all information you supply, including your relatives & friends, unless you specify.

We take your privacy seriously. Private tribute pages can be accessed only via password-protected links or unique QR codes. We use industry-standard security practices to safeguard your data. Please review our Privacy Policy to understand how we collect, use, and protect your information.

  1. Refund Policy

Due to the digital nature of our services, all purchases are considered final. However, if you believe there has been an error with your subscription or access, please contact us at support@preciousthoughts.co.uk and we will be happy to review your case.

If you are a consumer, you may have a statutory right to cancel your contract within 14 days of purchase under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013, unless you have expressly requested us to begin the service and acknowledged that your right to cancel is lost once the service is fully performed. Please contact us if you wish to exercise this right.

  1. Standards of Service

The Precious Thoughts Group Ltd provide a high-quality service in all aspects. If you have any questions or concerns about the service we provide to you, please raise them in the first instance with our designated senior person info@preciousthoughts.co.uk

As you are in control of the content that is within your account, we cannot be responsible for the content uploaded or the time it took to upload. Also, we cannot be responsible for the presentation of the Eulogy or content that you have provided. Your presentation could be by way of computer, audio and visual equipment or any other medium is not the responsibility of The Precious Thoughts Group Ltd. The performance of any third parties which may include, but not specifically limited to, Funeral directors, Vicars, Crematoria, Councils, Ministers, Civil Celebrants, etc.

  1. Limitation of Liability

Precious Thoughts is not liable for any indirect, incidental, or consequential damages arising from your use of the site or services. We do not guarantee uninterrupted access and reserve the right to suspend or discontinue services for maintenance or upgrades.

  1. Termination

We reserve the right to suspend or terminate your access to the site and services if you violate these Terms or misuse the platform in any way.

  1. Agreement

Your instructions will not create any rights enforceable by virtue of the Contracts Rights of Third Parties Act 1999 by any person not identified as our client.

If any of these Terms are unenforceable as drafted: – it will not affect the enforceability of any other of these Terms; and if it would be enforceable if amended, it will be treated as so amended. The parties agree that these Terms along with estimates and services accounts constitutes the entire agreement between them and supersedes all previous agreements, understandings and arrangements between them, whether in writing or oral in respect of its subject matter Notwithstanding anything else contained in these Terms, neither party shall be liable for any delay in performing, or non-performance of, its obligations hereunder if such delay or non-performance is caused by circumstances beyond the reasonable control of the party so delaying or non-performing, including but not limited to strikes, lock outs, labour disputes, acts of God, war, riot civil commotion, malicious damage, compliance with any law or government order, rule, regulation or direction, accident, disease, epidemic, pandemic, fire, flood, storm or adverse weather conditions.

Our liability is excluded to the maximum extent permitted by law including any implied terms.

No variation of these Terms shall be valid or effective unless it is in writing (including email).

  1. Governing Law

These Terms are subject to English, Wales OR Northern Irish Law. If any provision of these Terms shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. By accepting these Terms, you submit to the non-exclusive jurisdiction of the English, Wales or Northern Irish courts.

  1. Modifications to Terms

We may update these Terms at any time. If we do, we will notify you via email or a site notice. Continued use of the site after changes constitutes your acceptance of the revised Terms.

If you do not agree to the revised Terms, you may terminate your account and cease using our services.

  1. Online Safety & Content Moderation

We are committed to providing a safe online environment. The content can only be viewed by the client and their appointed person at the correct time. We endeavour to be compliant with the Online Safety Act 2023, therefore, the site is not available for under 18, if you believe any content on our platform is harmful, illegal, or breaches these Terms, please report it to us immediately. We reserve the right to moderate, remove, or restrict access to content as required by law or to protect our users.

  1. Dispute Resolution

If you have a dispute with us, please contact us in the first instance. If we cannot resolve your complaint, you may have the right to refer the matter to an Alternative Dispute Resolution (ADR) provider.
